Please read these Terms of Service ("Terms", "Agreement") carefully before using the quectos platform (the "Service") operated by quectos ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Service.
You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.
To access certain features, you may be required to register for an account using Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
The Service may utilize "Node Keys" or "Credits" for access to advanced features. These are defined as "Single-Use Digital Consumables."
Pursuant to the EU Consumer Rights Directive (2011/83/EU) and applicable local laws, you acknowledge that by activating a Node Key or beginning a "Session," performance of the contract has begun. You expressly waive your right of withdrawal once digital content delivery has commenced.
The Service and its original content (excluding Content provided by users), features, and functionality—including but not limited to the "Prism Engine," "Wilson Cloud Chamber" visualizations, and audio soundscapes—are and will remain the exclusive property of quectos. The Service is protected by copyright, trademark, and other laws of both Spain and foreign countries.
You agree to defend, indemnify, and hold harmless quectos, its Founders, developers, engineers, contractors, and licensors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. QUECTOS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE CONTINUOUS OPERATION, ACCURACY, OR SECURITY OF THE SERVICE.
THE SYSTEM OPERATES ON PROBABILISTIC NEURAL LOGIC. SUGGESTIONS, MODIFICATIONS, OR CODE GENERATION PROVIDED BY THE AI ARE NON-DETERMINISTIC. THE OPERATOR (USER) ASSUMES 100% LIABILITY FOR ANY ACTIONS TAKEN, CODE DEPLOYED, OR BUSINESS DECISIONS MADE BASED ON SYSTEM OUTPUT. WE ARE NOT LIABLE FOR "MODEL HALLUCINATIONS" OR DATA ANOMALIES.
IN NO EVENT SHALL QUECTOS, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Madrid, Spain.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
